Terms of Service
These terms ("Terms") govern your use of any iOS application published by Koirala Studio ("we", "us", "the studio") on the Apple App Store. By downloading, installing, or using any of our apps, you agree to these Terms. If you do not agree, do not use the apps.
1. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use our apps for your personal, non-commercial use on any compatible Apple device that you own or control. This license is granted for the duration of your use of the App Store and is subject to the App Store Terms of Service, which take precedence in the event of any conflict.
2. Subscriptions and auto-renewal
Some of our apps offer auto-renewing subscriptions. The following terms apply to all such subscriptions and are required disclosures under Apple's App Store rules:
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
- You can manage and cancel subscriptions by going to your App Store account settings after purchase: Settings → [your name] → Subscriptions.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.
- Subscription prices are shown in the app at the point of purchase. Prices are inclusive of any applicable taxes unless stated otherwise.
3. One-time purchases
Some apps offer one-time in-app purchases that unlock features permanently or for a defined period. Payment is charged to your Apple ID at confirmation of purchase. One-time purchases are tied to your Apple ID and can be restored on devices signed into the same Apple ID using the in-app "Restore Purchases" function.
4. Refunds
All payments are processed by Apple. We do not directly issue refunds. To request a refund, visit reportaproblem.apple.com within Apple's refund window. Apple decides all refund requests at its discretion.
5. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from our apps, except as permitted by applicable law
- Use our apps to violate any law or to infringe on the rights of others
- Resell, sublicense, or commercially exploit our apps
- Remove, obscure, or alter any copyright, trademark, or proprietary notices in our apps
6. Health and safety disclaimer
Some of our apps relate to health, fitness, motion tracking, or wellness topics. Our apps are not medical devices. They do not diagnose, treat, cure, or prevent any disease, condition, or injury. Information provided by our apps is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding any medical concerns. Do not disregard professional medical advice or delay seeking it because of something you have read or measured in one of our apps.
Apps that involve physical activity, exercise, or movement should not be used if you have any medical condition that physical activity could worsen. Use such apps at your own risk.
7. Disclaimer of warranties
Our apps are provided "as is" and "as available", without any warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and freedom from defects or interruptions. We do not warrant that our apps will meet your requirements, operate uninterrupted, be free of errors, or that any defects will be corrected.
8. Limitation of liability
To the fullest extent permitted by applicable law, in no event shall Koirala Studio, its operator, or any of its affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of or inability to use our apps, whether based in contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any and all claims arising out of or relating to our apps shall not exceed the greater of (a) the total amount you paid to us through Apple in the twelve months preceding the event giving rise to the claim, or (b) ten Canadian dollars (CAD $10).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the above limitations apply to the maximum extent permitted by law.
9. Changes to the apps
We may update, modify, or discontinue any of our apps at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuation of any app. We will give reasonable notice through the App Store or in-app for material changes affecting paid subscribers.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated through an update to the relevant app or by surfacing a notice within the app. Your continued use of an app after a change indicates your acceptance of the updated Terms.
11. Apple-specific terms
You acknowledge that these Terms are between you and Koirala Studio, not with Apple. Apple is not responsible for our apps or their content. In the event of any failure of an app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you. Apple has no other warranty obligation with respect to our apps. Apple is a third-party beneficiary of these Terms and is entitled to enforce them against you.
12. Termination
You may terminate your use of our apps at any time by deleting them from your device. We may terminate or suspend your access to our apps at any time, with or without notice, if you violate these Terms or for any other reason at our discretion. Upon termination, your license to use our apps ends immediately. Sections 4 through 14 survive termination.
13. Governing law and dispute resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or relating to these Terms or our apps shall be brought exclusively in the courts of Ontario, Canada, and you consent to the personal jurisdiction of those courts. If you are a consumer, this clause does not deprive you of any mandatory consumer protections under the laws of the jurisdiction where you reside.
